It is alleged that Bill S6276 was intended as a COVER UP for the DEP Cancer Cluster Buyouts
- It is alleged; that the Upstate Cancer Clusters were discovered by the NYS Dept of Health, on or about 2006 shortly after several severe rain events occurred across the Northeast.
- The areas involved are located along the Rondout Creek flood plain and the inhabitants are generally considered low income, minority , with most residents being high school educated.
- On or about 2008, the County Health Department informed residents in the DEP Designated Area by mail, "Not to Drink The Water" and that NYC would eventually give them all free bottled water, disinfection UV lights, and Chlorination systems. ( E coli was rumored in the newspapers, but test results have never been substantiated ) Newspaper Link
- Residents were lead to believe the contamination would be permanent
- It is alleged; NYC’s Primary Goal was to buyout and demolish the most contaminated properties first, provide a new public drinking water system to an additional 300 homeowners, and get all parties involved to sign health releases of future litigation, and give up their right to sue . . . WITHOUT MAKING ANY OF THE RESIDENTS SUSPICIOUS
- In 2010, Senator Bonacic created “Bill S6276” which explained to residents that it was the State's idea to buyout and demolish houses with groundwater seepage and make sure the properties would never be rebuilt upon again.
- NYC came up with matching funds after Bill S6276 was supposed to be in effect , and wanted to pay people an extra $20,000. each to sign health releases of litigation not to sue in the future
- These settlements occurred after the people had vacated their homes
- The combined funds came from NYS and NYC,
- It is alleged; that the task of administering the combined funds was designated to a third party, Ulster County to give NYC and NYS officials the option of Plausible Deniability.
- It is further alleged; that Senator John Bonacic made the critical and costly mistake of trusting Emergency Management Director Art Snyder, County Attorney / Contract Managers Beatrice Havranek and Susan Plonski, and Republican Legislative Counsel Langdon Chapman
- It is alleged; that an unanticipated double-cross occurred when Ulster County contract managers; Arthur Snyder, Beatrice Havranek, and Susan Plonski decided to skim funds off of the top of the NYS Disaster Relief funds.
- This Overt Act Constitutes "RICO" and Conspiracy

- The county contract administrators hired one single appraiser, Maria Pastena, to provide two separate appraisals for each house.
- The appraiser certified one appraisal dated as of 2004 with a high market value and then certified a second appraisal dated as of 2012, with a low market value, for each house, in the Designated Area.
- The residential homeowners were told no other appraiser or appraisal would be considered and/or tolerated by the administrators.
- The suspects would then offer the low appraisal to the homeowners on a "take it or leave it basis" as payment in full, and if the homeowner refused to accept, it meant immediate expulsion from the program with no remedy for filing a grievance, and no one to complain to, . . as per "Coercion"
- It is alleged; that the suspects then planned to send in the much larger appraisals to New York State for reimbursement
- The average difference between the two appraisals was approx. $18,000 per house,
- It is alleged; that the suspects would have pocketed the difference on each house as additional outside legal counsel fees and other miscellaneous administration fees paid to Ms. Plonski
- As part of NYS Procedural Oversight Law for buyouts, appraisals must be submitted to NYS for prior approval, at least a week prior, before a transaction can take place.
- It is alleged; that the suspects stalled sending in required property appraisals (schedule part B) to NYS for pre approval, for over eight months and ended up defaulting on NYSHARS2012009 and losing all of the NYS Funding
- According to OHCR vice president Chris Leo, (The RFP "request for proposals" lacked Part B (appraisals) and was sent in past the NYS deadline of 11/30/12) thereby defaulting
- NYC funding was 100 contingent upon the state funding being in place first
- It is alleged; that Executive Mike Hein and Senator Bonacic Panicked because they could not accept or explain to the public having lost all of the NYS and NYC funding, in the blink of an eye.
Plan B
- Plan B was to temporarily replace the lost NYS funds with bonded Ulster County Taxpayer money
- Plan B and NYSHARS 20120009 were still dependent on a Final Completion Contract Date of June 30th, 2013, . . . . as a combined comptroller's audit deadline loomed and was quickly approaching.
- As karma would have it, the NYS Labor Dept happened to be passing by the demolition of 7019 Route 209, on or about 4/1/13 and noticed a Violation of OSHA law (lack of an ESA2 on the demo permit) and ordered a STOP WORK order for several months which caused the 6/30/13 audit deadline to be missed
- Special Note:
- The County Health and Safety Dept Director “Adam Sessler” had been coerced into approving eight prior demolition permits including 7019 route 209, . . without ever having the mandatory Environmental Site Assessments 2’s in place
- ESA 2’s are State Mandated OSHA Requirements (Testing for groundwater and soil contamination)
Plan C,
- It is alleged; that on or about 6/30/13; The Ulster County Comptroller Elliott Auerbach along with The NYS Comptroller (unknown person) performed a joint procedural audit, . . Discovered the Frauds and Embezzlement, . . and then added yet a further layer of NYS cover ups
- It is alleged that due to the ongoing efforts of Whistleblower Mike Wendel, additional entities became involved in the RICO Conspiracy, on or about the end of July 2013, who not only turned a blind eye, but became complicit with the Contract Managers efforts of Coercion and Whistleblower Retaliation
- It is alleged those individuals include District Attorney Holley Carnright, Judge Donald Williams, Investigator Paul Waska, and Sheriff Van Blarcum
- Wendel was left to fight the County Administrators, Alone, . WITHOUT the law or any Civil Rights
- Malicious Prosecution became the County Administration's #1 Weapon, while the law turned a blind eye
